The Crea y Crece Law and Electronic Invoicing: A Step Towards Business Digitalisation
- 26/11/20254
In an increasingly digital business world, adapting to new regulations is key to staying competitive. In Spain, the Crea y Crece Law, approved in September 2022, is designed to promote the creation and growth of companies by simplifying procedures and modernising processes, including electronic invoicing. This law marks a turning point for companies looking to optimise their administrative processes and align with technological trends.
What is the Crea y Crece Law?
The Crea y Crece Law, enacted in September 2022, has as its main objective to encourage entrepreneurship, facilitate the creation of new businesses and support the growth of SMEs through digitalisation. This legislative framework addresses several key aspects, such as the elimination of bureaucratic obstacles, improved access to financing and the promotion of electronic invoicing as an essential tool for modernising business management.
One of the most notable measures of the law is the obligation to use electronic invoicing in transactions between companies and with public administrations. This change has a major impact on the way companies manage their commercial relationships and how they fulfil their tax obligations.
Electronic Invoicing: A Requirement Under the Crea y Crece Law
Electronic invoicing is not new in the business landscape, but with the entry into force of the Crea y Crece Law, it becomes an obligation for many companies operating in Spain. This regulation aims to streamline administrative procedures, reduce tax fraud and improve operational efficiency through the use of electronic documents.
What Does Electronic Invoicing Entail Under the Crea y Crece Law?
The law establishes that companies must issue and receive electronic invoices in all commercial transactions with other companies and with the Public Administration. This means that invoices must be in digital format, with a unique code and following a common standard that allows their storage and retrieval in electronic form.
To comply with the law, companies will need to adopt electronic invoicing systems that ensure the integrity, authenticity and legibility of invoices, which helps prevent tax fraud and improves control over commercial operations.
Which companies are affected by the electronic invoicing obligation?
With the entry into force of the Crea y Crece Law, companies will be required to issue electronic invoices to other companies or self-employed professionals for services rendered. This obligation had already applied to relationships with public administrations and their suppliers since 2015.
The implementation of mandatory electronic invoicing will be carried out in different timeframes, depending on billing volume:
- Companies with annual turnover exceeding 8 million euros: must adapt within 1 year from the approval of the technical regulation.
- Companies with turnover below 8 million euros: will have a period of 2 years from the approval of the technical regulation to implement electronic invoicing.
How Does ERPCloud Comply with the Crea y Crece Law?
ERPCloud ensures compliance with the Crea y Crece Law through the issuance of electronic invoices in Facturae (XML) format, guaranteeing that tax data is correct. It integrates electronic signatures to validate the authenticity of invoices and stores them securely in the cloud for at least 4 years. It facilitates the automated sending and receipt of electronic invoices, optimising processes. Furthermore, it complies with implementation deadlines based on billing volume and offers continuous updates and support to ensure regulatory compliance.
